Carlsbad CA— Results for today’s special election in Carlsbad on Measure A , the Agua Hedionda South Shore Specific Plan, will be reported by the County of San Diego Registrar of Voters, starting a little after 8 p.m., when the polls close. The 8 p.m. report, available at www.sdvote.com, will include results from early voting at the registrar’s office and mail ballots received up until Election Day.
The Registrar of Voters will provide updates on its website as the count continues. The count is considered unofficial until the registrar certifies the election results. The registrar has 30 days to complete the count and certify the election results, however since the ballot only has one item, it could be done sooner. Once certified by the Registrar of Voters, the election results must be certified by the Carlsbad City Council at its next regular City Council meeting.

If Measure A Passes

If Measure A passes, the ordinance approving the plan would go into effect 10 days following the certification of the results by the City Council. Following are the steps that would follow:

  • Litigation continues on North County Advocates v. City of Carlsbad, a case filed Oct. 27, 2015, that seeks to overturn the approval of the plan.
  • City resubmits Local Coastal Plan Amendment Application to California Coastal Commission.
  • Caruso Affiliated submits Coastal Development Permit application to California Coastal Commission.
  • Coastal Commission takes action on the Local Coastal Plan Amendment and Coastal Development Permit.
  • If approved by the California Coastal Commission, Caruso Affiliated submits design and construction plans to the city for review.
  • If approved, the city issues construction permits and construction begins.

If Measure A Fails

If Measure A fails:

  • The ordinance approving the plan would be rescinded 10 days following the election certification by the City Council.
  • The land use designations would remain as they are today, with visitor-serving commercial development allowed on 48 acres and the other 155 designated for open space.
  • At any time, Caruso Affiliated could submit the Agua Hedionda South Shore Specific Plan, or another plan, to the city via the traditional development process, which includes California Environmental Quality Act analysis and review by the California Coastal Commission.
  • The City Council may not approve an ordinance for the Agua Hedionda South Shore Specific Plan for 12 months following its certification of the election results.
  • If Caruso Affiliated terminates its contract with SDG&E to purchase the land, another party could purchase any or all of the property, at the discretion of SDG&E, the current landowner.
