Lawsuit Claims Carlsbad is Violating the City’s Growth Management Plan
Carlsbad CA— North County Advocates (NCA), a local non-profit community group, announced in a press release on Wednesday that a suit was filed over the City of Carlsbad’s failure to comply with the City’s Growth Management Plan.
In 1986, Carlsbad voters overwhelmingly passed Proposition E, which adopted the Growth Management Plan. The Growth Management Plan laid out “performance standards” in several areas, including open space, parks, libraries, and traffic circulation. The measure guaranteed that forty percent of Carlsbad would remain open space, and ensured that no development could be approved by the City unless the required open space and all other facilities, as provided in the Growth Management Plan, had been met. “The City is currently not in compliance with a number of the GMP performance standards including those for open space, parks, and traffic circulation, “said NCA’s attorney Everett DeLano. “Proposition E was passed by the voters to ensure that all areas of the city would have access to open space and parks, and that sensitive lands would be protected.” NCA raised concerns about open space and other items numerous times with the City over the last few years. However, as they did with the recent reports of traffic failures, the City refused to acknowledge that they are failing to meet this critical performance standard and refused to take any corrective action.
NCA President Dr. Howard Krausz says, “We believe it is critical to address this shortfall now, before all of the land is developed. This lawsuit has been filed today on behalf of all of the residents of Carlsbad who voted in 1986 to ensure adequate parks and open space, and all of the residents of the future who see open space as a key part of the fabric of this community.”
