Oceanside CA— The Oceanside Police Department has been made aware through various news media reports and concerned members of the community of the potential early release of David Herbert. Herbert was convicted in 2018 of animal abuse, vandalism, residential burglary, and using a weapon during the commission of a crime. See original story [Here]
Herbert was sentenced to 9 years 8 months in state prison. Based on the State of California sentencing laws, Herbert was scheduled to be paroled in February 2021. Due to COVID-19, Herbert may be eligible for an even earlier release pursuant to criteria set forth by the State of California. Click here to see the criteria.
Neither the Oceanside Police Department, the San Diego County District Attorney’s Office nor the victims were consulted prior to this decision being made, and the Oceanside Police Department does not have any involvement and/or influence in such a decision.
